【摘 要】随着互联网时代的推进，“人肉搜索”事件大量出现。作为一种信息搜寻的方式，“人肉搜索”是公民行使言论自由和信息自由的表现，它在客观上起到公众舆论监督和震慑违法行为的作用。但“人肉搜索”又是一把双刃剑，使用不当便极容易引发网络暴力，与公民个人隐私权的保护相冲突。笔者认为，“人肉搜索”作为一种搜索引擎，有其存在的必然性和合理性，但是我们需要给“人肉搜索”构建一个合理的制度框架，在保护言论自由和公民隐私之间寻找一个最佳的平衡点，从而为“人肉搜索”的良性发展创造更加健康的环境。

The author thinks, "human flesh search" as a search engine, has the necessity of existence and rationality, but we need to give "human-powered search" to construct a reasonable system framework, to protect freedom of speech and citizens in between looking for a best of privacy, thus for "people balance development of flesh search" create a more healthy environment.
