[内容提要] 我国2001年4月修订的《婚姻法》第一次以立法形式明确夫妻忠实义务,本文着重论述夫妻忠实义务的概念,对夫妻忠实义务的法律性质作出界定,然后从我国社会主义性质和国情、法理研究以及司法实践等角度阐明在婚姻法中规定夫妻忠实义务的必要性,最后,本文着重对“忠实”的法律性质定位、违背夫妻忠实义务是否可以作为法定离婚事由以及违背此义务的过错方应否承担损害赔偿责任等问题作了详细的论述,在现存的理论观点和立法与司法解释规定的基础上提出了自己的一些观点和看法,以期有助于对该问题的认识的深化.
