Article 6 Disputes
(1) In the event of any dispute or any difference arising out of or relating to this Contract or the breach of this Contract ,the parties shall consult and negotiate with each other in good faith and understanding of their mutual interests to reach an equitable solution satisfactory to all parties .If they do not reach such solution within a period of thirty (30) days:then the disputes or differences shall be finally settled by arbitration in accordance with the procedural rules of the Belgian Code of Civil Procedure.
(2) The Arbitration Tribunal shall be formed of three (3)arbitrators one (1)to be appointed by each party ,and the third to be appointed by the first two (2)arbitrators ,or in the event of their failure to agree within thirty (30)days:by the Court of Appeal of Brussels.The arbitrators must be familiar with the commercial practices of the Medical and Travel Assistance Services in which the parties operate .
(3) The place of arbitration shall be Brussels,Belgium,and the arbitration shall be conducted in English,To the extent that the arbitration procedure is not covered by the Rules of Arbitration ,it shall be decided by the arbitrators,The arbitration award shall be final,binding on the parties ,not subject to any appeal to the ordinary courts and shall deal with the question of costs of arbitration and all matters related thereto .
(4) The arbitration award shall be written in English.Judgement upon the award rendered may be entered into of the award or an order of enforcement .
(5) Both parties represent that an arbitration award rendered pursuant to this Clause with respect to any dispute or difference arising out of or relating to this Contract is enforceable under the laws of Belgium and of the country where the GlobMedNet-servise Provider’s registered office is situated.
Article 7 Language of the Contract
The legally binding version of this Contract shall be the duly executed English version which shall be exclusively used for the construction of this Contract .
